Terms of Service

1. Acceptance of Terms

By accessing or using the Trelliss platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

Trelliss is a multi-tenant helpdesk and customer support platform sold via the Microsoft Azure Marketplace. The Service provides ticket management, customer portals, team collaboration, and administrative tools for support organisations. Features and functionality may be added, modified, or removed as the platform evolves. We will endeavour to communicate significant changes in advance.

3. Account Registration

• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorised use of your account.
• You must be at least 18 years old to create an account.

4. Subscriptions and Billing

Trelliss is available exclusively through the Microsoft Azure Marketplace. Your subscription and billing are managed by Microsoft as part of your existing Azure agreement. Your commercial relationship for billing, invoicing, and payment is with Microsoft, not with Trelliss or Indigo Chicken.

• All subscription fees are processed through your Microsoft Azure subscription and are subject to the Azure Marketplace Terms.
• Free trials last 14 days from the date of provisioning.
• After the trial period, you must select a paid plan to continue using the Service.
• Refunds, cancellations, and billing disputes are handled through the Azure Marketplace in accordance with Microsoft's policies.
• We reserve the right to change pricing with 30 days' notice. Price changes take effect at the start of your next billing cycle.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit malware, viruses, or other harmful code
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service for any unlawful, fraudulent, or abusive purpose
• Resell or redistribute the Service without our prior written consent

6. Data Ownership

You retain all rights to the data you upload to or create within the Service ("Your Data"). We do not claim ownership of Your Data. You grant us a limited licence to host, store, and process Your Data solely for the purpose of providing the Service to you.

7. Multi-Tenancy and Data Isolation

Each tenant on the Trelliss platform is provisioned with a separate, isolated database. Your Data is never co-mingled with data from other tenants. We maintain strict access controls to ensure data isolation at both the application and infrastructure levels.

8. Service Availability

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by factors outside our reasonable control, including Azure platform outages.

9. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Indigo Chicken Ltd and is protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

10. Termination

• You may cancel your subscription at any time through the Azure Marketplace. Cancellation is governed by Microsoft's marketplace policies.
• We may suspend or terminate your access to the Service for violation of these Terms.
• Upon termination, your tenant data will be archived for 30 days and then permanently deleted.
• You may request a data export during the 30-day archive period by contacting us at [email protected].

11. Limitation of Liability

To the maximum extent permitted by law, Indigo Chicken Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities arising out of or related to your use of the Service. Our total liability for any claims arising under these Terms shall not exceed the fees attributable to your use of the Service in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Trelliss and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
